Medical negligence and surgical errors can result in both death and catastrophic injuries. Medical professionals and medical facilities may be responsible to compensate victims who have suffered harm as a result of medical negligence. Both medical professionals and medical facilities may be liable for medical negligence if the health care provider does not adhere to the standard of care. The standard of care is a standard developed by determining what a reasonably prudent medical professional would do in similar circumstances. If the medical professional or medical facility failed to adhere to that standard of care, they may be liable to compensate the victim for damages.

Medical malpractice can be proved a number of different ways and medical experts may be utilized in the process. The victim of medical malpractice must demonstrate that there was a doctor-patient relationship that established a duty to provide care; what the standard of care is and how the medical professional or medical facility failed to adhere to that standard; and how the failure to properly adhere to the standard of care caused the harm the victim suffered. In addition, the victim must specify the harm they have suffered which establishes the basis for damages.

Medical malpractice claims allow victims of medical negligence to hold medical professionals and medical facilities that have caused them harm accountable. A negligent health care provider may be responsible to compensate the victim or victim's family for damages suffered as a result of the medical negligence.

Victims and family members who believe they are victims of medical malpractice should be familiar with what medical malpractice is and how a medical malpractice claim may help protect them from additional harm down the road.
