Many residents of Virginia may be aware of the accident involving comedian-actor Tracy Morgan that resulted in him sustaining serious injuries. In the same wreck, another comedian, James McNair, was killed. The accident occurred when the Limousine van carrying the artists was hit by a Wal-Mart truck. Since then, this incidence has triggered a nationwide concern and has also initiated a meeting by the National Transportation Safety Board in Washington, D.C.

Investigations by the NTSB revealed that the Wal-Mart truck was being driven at a speed above 60 mph in an area where the speed limit was restricted to 45 mph. There was also some construction work going around in that area. The driver, who was charged with death by auto and four counts of assault, has admitted to being sleep-deprived for 24 hours at the time of the accident. It has been assumed that this fatigue was the primary cause behind the truck accident.

The motor vehicle laws in New Jersey suggests that a person can be charged with assault if that person is found to be driving a motor vehicle without having slept for over 28 hours. Based on this and the trucker's negligence, Morgan and his friends have sued Wal-Mart for an undisclosed amount..

The meeting held by members of the NTSB has resulted in nine new safety recommendations for trucking rules in the state. Wal-Mart also proposed to implement a fatigue management program to educate its drivers. As reports state, the NTSB highlighted the fact that truck driver fatigue was a crucial factor in the accident that led to serious consequences for several people and their families, so it is hoped that the changes will help save lives.

Fortunately, in the event of accidents such as this, victims have the choice of seeking legal recourse. A firmly grounded claim may help victims recover compensation for expenses incurred for medical treatment, the loss of wages and benefits due to absence from work, and the pain and suffering that they had to endure.
